  1. Am I being sued?
    No, you are not. If you received a notice in the mail from the Claims Administrator, you are a member of the class. (Top)

  3. Why didn't I receive a notice in the mail?
    Probably because we don't have your current mailing address. The best way to correct your address is to telephone the Claims Administrator at 773-896-9016. You can also send us e-mail with your name, date of birth, old address, and current address by using the Contact form on this website. (Top)

  5. What is a Class Action?
    In a Class Action, one or more people called Class Representatives sue for people who have similar claims. All these people are a Class or Class Members. One Court will resolve the common issues for everyone in the Class. The lawyers representing the Class are called "Class Counsel". (Top)

  7. Why is there a settlement?
    The principal reason for the settlement is the benefit to be provided to the Class Members now. This benefit must be compared to the risk that no recovery might be achieved after a contested trial and likely appeals, possibly years into the future. While defendants deny any liability or damages, an additional risk plaintiffs considered is the possibility that, even if they succeeded in establishing liability and damages, defendants' resources would not likely support a greater recovery than is being obtained by this settlement.   11. How much will I get from the Class Action Settlement?
    Based on the numberf of claims submitted by October 31st, class counsel believes that each class member will receive $200. (Top)

  13. How do I get a payment?
    You must return the Claim Form sent in the mail with the Notice of Settlement by November 22, 2007. If the settlement is finally approved by the Court, you should receive your check by December 31, 2007. (Top)

  15. Do I have to pay anything?
    No, as a Class Member you do not have to pay anything. (Top)

  17. Should I get my own lawyer?
    You do not have to hire your own lawyer because Class Counsel is working for of all Class Members. If you want your own lawyer to separately represent your own interests, you may hire a lawyer at your own expense. (Top)
